1 Introduction
Welcome to HabitaLink. By downloading, accessing, or using our mobile app and web platform (the "Service"), you agree to be legally bound by these Terms and Conditions. If you do not agree with any of these terms, you must not use the Service.
2 Service Description
HabitaLink is a SaaS (Software as a Service) platform designed to facilitate communication and management between condominium/community administrations (HOA) and their residents.
Important clarification: HabitaLink is a technology provider. We are not property managers, we are not responsible for the physical security of your community, and we do not guarantee the execution of maintenance services requested through the App. Responsibility for operational management rests exclusively with your HOA Board or Administration.
3 Accounts and Security

Registration: To use the service, you must have a registered account, generally created or authorized by your community administration.

Responsibility: You are responsible for maintaining the confidentiality of your password. You agree to notify HabitaLink or your administration immediately of any unauthorized use of your account.

Accurate Data: You agree to provide truthful and up-to-date information about your housing unit and contact details.
4 Acceptable Use and Code of Conduct
Because HabitaLink includes social features (Announcements Wall, Chats), the following are strictly prohibited:
- block Harassment, intimidation, defamation, or offensive language toward other residents or administrative staff.
- block Posting illegal, obscene content, or content that violates third-party privacy.
- block Using the platform for spam or advertising not authorized by administration.
Consequence: HabitaLink and community administration reserve the right to suspend temporarily or permanently the account of any user who violates these rules.
5 Intellectual Property

The Platform: The software, design, source code, and HabitaLink logos are the exclusive property of HabitaLink.

User Content: Texts, photos (e.g., maintenance reports), and documents uploaded by users remain the property of the user or community administration, but you grant HabitaLink a license to host and display such content within the platform for service operation.
6 Privacy and Data
The use of your personal data is governed by our Privacy Policy. By using the app, you consent to collection and use of your information (such as name, unit number, and email) for purposes strictly related to community management.
7 Limitation of Liability
The service is provided "as is." HabitaLink:
- info Does not guarantee uninterrupted or error-free service.
- info Is not responsible for disputes between residents arising in chats.
- info Is not responsible for indirect damages resulting from communication failures related to a maintenance report (e.g., if a leak is not repaired in time because the administrator did not see the notification).
8 Service Modifications
We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part of it) with or without prior notice, although we will try to notify significant changes.
9 Governing Law and Jurisdiction
These terms are governed by and interpreted in accordance with the laws of the Republic of Guatemala. Any legal dispute related to these terms will be subject to the exclusive jurisdiction of the courts of Guatemala City.
